Tenancy Deposit decision

James Browne appeared for the successful appellant in the recent High Court decision in Draycott v Hannells Lettings Ltd [2010] EWHC 217 (Tugendhat J), a case offering the first insight by the higher courts into the recently introduced legislation on tenancy deposits. The case provides guidance as to whether a landlord's agent is liable for penalties under the Housing Act 2004 and whether the landlord and/or agent is liable where the tenancy deposit is only protected later than 14 days after its receipt.

CJCGQC upheld
21 May 2009
Associate member Christopher Gardner's judgment as Chief Justice of the Turks and Caicos Islands in Swann v AG Turks & Caicos Islands was upheld today by the Privy Council. Delivering their Lordships' opinion, Lord Neuberger of Abbotsbury considered the Chief Justice's decision "unassailable".
Property Seminar

Talks by Simon Brilliant and Richard Hayes were warmly welcomed at a well attended seminar held by the Property Group. Simon's clear insight (as a Deputy Adjudicator) into appearing before the HM Land Registry Adjudicator, and Richard's well-researched and timely presentation on insolvency in landord and tenant cases, received high praise from attendees, and qualified for 1.5 hours of CPD.

IDR Group Reception
On 30 April 2008 the Head of Lamb Chambers, John Cherry QC, attended a reception at the Houses of Parliament.
The Attorney General, Baroness Scotland of Astal QC, was the guest speaker at the reception, which was held to mark the launch of THE IDR GROUP®. The reception was held in the Commonwealth Parliamentary Assocation Room in Westminster Hall: built in the 11th Century Westminster Hall is the largest surviving part of the original Palace of Westminster.
The Head of THE IDR GROUP® is Anthony Connerty, a member of Lamb Chambers.
Lord Anderson of Swansea introduced the Attorney General, stresing her links to the Commonwealth. Baroness Scotland then spoke of the importance of arbitation and alternative dispute resolution in international affairs. She welcomed the creation of the Group in a world where international trade was forever increasing.
Lord Anderson later introduced Anthony Connerty, who gave a brief description of the Group.

They are qualified and experienced in international commercial arbitration and other dispute resolution processes.

Challenger EU challenge

Colin Challenger was instructed by ApTibet, a UK charity and NGO, which is believed to be the first NGO to secure a judgment - and the first party to obtain default judgment - against the European Commission. The Commission disputes jurisdiction, and has taken that point in enforcement proceedings before Master Fontaine. Her judgment on the issue is reserved.
Bogus email scam
It has come to our attention that members of the public may have received unsolicited emails purporting to have been sent by members of Lamb Chambers. The email seen by us refers to the recipient having won a lottery (or otherwise come into money) and a member of chambers having been appointed to deal with such. There may be other variations in circulation. Such emails are bogus. For the avoidance of doubt we do not send unsolicited emails to - or otherwise approach directly - members of the public. We do not deal with the financial affairs of members of the public. If you have any concerns about, or wish to check the origin of, an email you have received which purports to have been sent by us please telephone on 020 7797 8300 (outside the UK: +44 (0)20 7797 8300) and disregard any telephone number included in such email.
50 years of New York Convention
Sir Robin Auld and Christopher Gardner QC attended the Conference in New York held to celebrate 50 years of the New York Convention, presented by the Arbitration Committee of the International Bar Association in cooperation with the United Nations.

23 year compensation battle success

John Cherry QC, instructed by Janet Baker of Keeble Hawson, has secured a substantial compensation package for Sarah Ashton, who suffered hypoxic brain damage at birth nearly 23 years ago. At a High Court hearing before Mr Justice Tugendhat on 15th June 2007, approval was given to a lump sum payment of £1M and index-linked periodical payments of £100,000 PA for life. The capital value of the claim was about £4.1M. The defendant, Yorkshire & Humber Strategic Health Authority, had admitted liability at an earlier stage of the proceedings.

Multi-million settlement

John Cherry QC recently hosted the Minister of Justice of Finland while advising that state's Personal Injury Advisory Board, following his ongoing work on the JSB Guidelines for Assessment of General Damages in Personal Injury Cases.
