Summers v (1) Power (2) Aviva Insurance

Mark O'Grady was instructed by the Defendant insurer, Aviva, to resist an application by the Claimant to amend its Particulars of Claim relating to a Road Traffic Accident.  The Claimant sought to add a claim for loss of earnings, which would have increased the value of the claim by £100,000, and also have the claim reallocated from the Fast Track to the Multi-Track.  Before HHJ Venn, Mark was successful in defeating the Claimant’s application, and the matter proceeded to trial on the Fast Track.
