November 2012

This month’s edition focuses on the guidance provided by the Supreme Court on what makes a house a house and the  Court of Appeal’s clarification of how the 10% increase in general damages announced in Simmons v. Castle is to be implemented.

Commentary is also provided on the degree of leniency to be shown to litigants in person in light of the case of Tinkler v. Elliot. Finally, we are reminded that the LVT is not an unfettered inquisitorial tribunal in Birmingham City Council v. Keddie and Hill.
