March 2013

This month we focus on the Court of Appeal's decision in Kudos Catering (UK) Ltd v Manchester Central Convention Complex Ltd [2013] EWCA Civ 38, a case concerning the exclusion of contractual liability; in which our very own James Stuart appeared for the Applicant.

We also examine the tougher stance the Court is taking with regard to applications for relief from sanctions under CPR 3.9.

Finally, we focus on Personal Injury matters by examining the High Court decision in Uren and (1) Corporate Leisure (UK) Limited and (2) Ministry of Defence[2013] EWHC 353 and the forthcoming ban on referral fees in low value RTA cases and changes to the Fixed Recoverable Costs regime in the RTA portal scheme.
