Wills and the administration of estates

Our members can assist with issues such: the validity of a Will; competing Wills; and the construction of a Will’s provisions.

We are also able to assist where steps need to be taken in the administration of estates, such as where a claim is to be pursued on behalf of the estate or in instances of intestacy.

Inheritance disputes

Chambers has experience at all levels of Call in dealing with claims brought under the Inheritance (Provision for Family and Dependants) Act 1975.

Trusts

We offer advice and advocacy in relation to a broad range of trusts disputes, including: the drafting and interpretation of express trusts (as provided, for example, under a Will); implied trusts (such as constructive trusts arising out of unconscionable conduct); trusts of land under TOLATA; tracing claims; the administration of trusts; and disputes concerning the fiduciary duties owed by appointed trustees and other persons (such as solicitors).
