The Insolvency and Corporate Governance team has significant experience in all areas of personal and corporate insolvency, and company work. The range of expertise within the group across Insolvency and Corporate Governance work is such that members are well placed to deal with cases which raise multi-disciplinary issues.

Insolvency issues can arise frequently in commercial and personal life. The range of different forms of insolvency, options and consequences present a complex challenge for anyone unfamiliar with this area.

Our specialists are able to analyse and explain legal issues in a sensible, commercial and accessible manner. They are experts in all aspects of bankruptcy and compulsory and voluntary liquidations.

Sometimes insolvency can also be avoided, and our members are also able to help achieve this through pre-action advice on serving and responding to statutory demands as well as advising on alternatives including individual, partnership or corporate voluntary arrangements, administration, receivership, and restructuring.

The Insolvency and Corporate Governance team also has significant experience in all areas of company work, ranging from incorporation through to dissolution, and in connection with companies of all sizes from family enterprises to PLCs.

Members’ expertise extends to the law relating to directors’ duties; shareholder rights; internal management; quasi-partnerships; unfair prejudice and derivative claims. Some members also undertake non-contentious advice and drafting of Company constitutional documents.
