Winston Jacob of Lamb Chambers represents the Appellants, who will be asking the Supreme Court to overturn the Court of Appeal’s decision that the right to manage cannot be claimed over a block of flats if it shares an open plan car park with neighbouring blocks.
The appeal raises important issues of statutory construction relating to the qualifying criteria for premises to which the right to manage applies in s. 72 of the Commonhold and Leasehold Reform Act 2002. The decision is likely to apply to a large number of properties throughout England and Wales.
