Winston was named Lawyer of the Week for his successful representation of the Appellant right to manage company in the Supreme Court in Avon Freeholds Ltd v Cresta Court E RTM Co Ltd [2026] UKSC 31. The successful appeal enabled tenants in Cresta Court to finally wrestle control of management of their block from their landlord after four years of litigation. The Supreme Court held that a landlord cannot object to the acquisition of the right to manage based on a procedural error by the right to manage company that caused it no prejudice. The Supreme Court’s decision is not just a success for the Appellant but also limits the ability of landlords in future cases to object to acquisition of the right to manage on procedural grounds. Winston appeared in the Supreme Court with Christian Fox of Lamb Chambers.
